Is It Time To Refinance?

In this changing market I have been receiving many calls from homeowners asking me if its time for them to refinance their mortgage. As you are aware, many homeowners obtained adjustable rate mortgage loans or interest only mortgage loans during the recent real estate boom in South Florida. Now, there are many reasons that homeowners are deciding to refinance their mortgage loans, including their traditional thirty (30) year loans. It is essential to identify why the homeowners wants or needs to refinance the mortgage before answering the question of whether now is the time to do so.

There are a few typical reasons homeowner's refinance, but the most common are so that the homeowner may lower his/her interest rate, lower the monthly mortgage payment, and to take out cash from the home's equity.

When deciding on whether the interest rate is low enough, some experts feel that the general rule of thumb is that the interest rate should be one (1%) to two (2%) percent lower than your current interest rate. Also note that sometimes the interest rate may not be the deciding factor if the homeowner's monthly mortgage payment is too high or the homeowner has an adjustable rate mortgage.

Homeowner's must spend the time to evaluate their goals- if the homeowner has a need for lower monthly payments either lengthening the loan to a thirty (30) year term, or turning an unpredictable adjustable rate loan into a fixed rate loan may be more important than actually lowering the interest rate by the often cited one (1%) to two (2%) percent.

Many homeowners use the equity in their homes to pull out cash for home remodeling or for consolidating other debts. The benefit of the smart home remodel is that the homeowner may raise the home's value for the future sale. Homeowners must consider carefully the type of remodel they are planning and discuss them with their realtors. Realtors are in the best position to advise the homeowner on which remodels will yield the highest returns at sale.

Additionally, refinancing to consolidate higher interest rate debts, such as credit cards, into one lower monthly payment may make sense for many homeowners. An important result is that the homeowner may receive a tax deduction from the mortgage interest payments that is not available on the interest from the credit card debt. Consult a tax advisor to determine if this is a viable option.

The primary residence continues for most homeowners to be their biggest asset. Stripping out most or all of the equity in their homes may not be the best decision in some cases. In other cases, the homeowner needs cash now, and there will be time to rebuild equity before their house is sold in the future. Homeowners should talk to a professional about this important decision before signing any documents that affect their primary residence. Homeowners must understand what the charges are to refinance and review the closing costs before making the decision.

Foreclosures have not been touched by the black plague; many are good options to look at when shopping for a home. Sometimes they do need to be fixed up, but other times you can move into them right away. Despite the negative impression many buyers have, foreclosures can be a great way to buy a home and gain instant equity.

First, it is valuable to understand how a home becomes a foreclosed property. A simple definition is that someone borrowed money to purchase the home, and then stopped paying the money back (a.k.a. going into default on their mortgage). This allows the lender to take legal action and obtain ownership of the home to recoup their losses; and in turn causes the homeowner who was in default to lose any equity they had built in the home. You would think that banks would be happy to take the home to cover the money they loaned out; however it is bad for them to keep foreclosures on their books. To alleviate the problem lenders typically try to auction or resell the house as quickly as possible.

HUD (Housing and Urban Development) homes are also foreclosed properties. They are different from normal foreclosures because the lender for the loan was a government lender such as FHA (Federal Housing Administration) or VA (Veterans Affairs). When owners with government loans go into default, HUD steps in to take over the property and try to resell or auction it.

Now you know what a foreclosure is, and you can consider foreclosed properties that catch your eye without fear of the unknown. Keep in mind that you should still go through all of the appropriate channels to check out the house structurally and functionally before you make a buying decision. This includes getting a proper home inspection. An inspection will point out any existing or potential problems and will allow you to factor in estimates for repairs that will need to be made to the home right away. These repairs may include plumbing or wiring, the roof, flooring, paint and so on. Making these calculations will help you figure out the amount of equity you will really end up with, and allow you to make the best decision financially.

As you continue your search for a home, remember that foreclosures can be a good investment for your family. By doing your research you can find and entertain more options then you might have realized that meet both your price and living space needs.

3 Tips on How to Buy Foreclosures for New Investors

National home sales rose 2.9% in February giving hope to the nationwide slump in house sales. Savvy home buyers are beginning to realize that one man's misfortune can be another man's fortune. Foreclosed homes are the main force driving this welcome birth in new home sales. Some markets like Las Vegas are reporting that foreclosed homes make up as much as 40% of reported sales in the real estate market.

Many of these purchases are being made by investors large and small. If the housing market were a blue chip stock analyst would be screaming buy, buy, buy. House prices and property values are almost certain to come up in the future leaving those who bought homes today in very good financial shape. This being said, there are a few pitfalls that would-be investors need to look out for when attempting to buy foreclosures in today's market.

1) Location, Location, Location - We have all heard this before but it has never rang truer than it does today. Whether you are buying your home to "flip" or buying your home to keep as a rental property location is your first key consideration. With foreclosures looming in almost every neighborhood you need to look for neighborhoods with the least amount of foreclosures in them. These are the properties that will "heal" first as the market begins to turn around.
These homes will tend to be in the middle to upper priced neighborhoods. You should choose your price range according to your intended use of the property. If your goal is to rent the property, be careful not to buy too much home because most people that can afford to rent higher priced homes can also afford to buy them. Look for lower priced homes in good neighborhoods and close to schools. Transversely, if your goal is to flip the house and you have the capital to hold the home for an extended amount of time larger houses will bring larger profits.
2) Buying "Fixer uppers" - Most would-be new investors that I speak with are looking for this type of property to purchase. It is true that these properties offer a much higher reward when purchased correctly, but they also represent the largest reasons new investors fail. Unless you have "deep" pockets, meaning you can purchase the home out-right or put a substantial amount down new investors should stay away from homes that need a lot of repairs.
Buying a home to fix-up and flip or rent can open up a can of worms that even the savviest investors have problems with. Contractors, inspectors and weather delays are all intangibles that you cannot foresee. Not to mention, if you have this home on a high interest ARM or hard money loan and you hit delays in repairs or renting the property you could lose planned profits for years to come. My advice is to begin with a home in good shape that you can get at a bargain price to get your "feet wet" and move on to distressed property as you build your reserves and experience.
3) Hard Money Lenders - If I had a nickel for every time a new investor asked me for a hard money loan I would be rich. Hard money loans are analogous to commodities in the stock market. Even the most experienced traders get burned with commodities every once in a while, and the inexperienced are almost certain to be burnt. So it goes in the housing market, hard money loans are one step above a loan shark. They loan money on low loan to value homes and wait eagerly for the investor to fail. They follow the foreclosure laws in each state step by step and are extremely efficient at taking properties should the investor "slip".
However, in the defense of hard money lenders they do play an important role in the careers of many investors. If you have ample capital, good prospects for selling or renting the home they can be an indispensable asset to experienced investors. Experienced investors are prepared for and can even anticipate delays in construction, renovations and slow rental markets. For new investors we suggest buying a home through traditional channels to begin with. Once you have ample reserves and some experience you can move to the bridge loans and hard money loans.

There are many other pitfalls to look out for but these three seem to be the top three I see new investors making. For fast mortgage closings and peace of mind we suggest that you find a good mortgage company that you trust and stay loyal. Building good relationships with builders, mortgage companies, and realtors can go a long way to helping the new investor survive in today's real estate market.

Even if the project has a great product, team, and customers, it may not be the impression the lender or investor gets, if the plan has not been properly prepared.

Funders, either traditional lenders, or equity funders, or 'angel' investors, see thousands of business plans each year, and, apart from a referral from a trusted source, the business plan is the only basis they have for deciding whether or not to lend to, or invest in, a project.

So, whoever is presenting the business plan must ensure that properly the business plan is properly prepared, and is presented properly. Be aware that this may involve you having to 'go back to the drawing board', perhaps even several times. However, at the end of the day, you will see the benefit it reaps.

With so many opportunities being presented to them, many investors, and particularly lenders, have made a virtue out of declining most presentations. They reason that entrepreneurs who know what they are doing will not make fundamental mistakes. Every mistake counts against the applicant - and it does not make you, the applicant, look good.

However, you need to be able to present a business plan, which looks very professional. So, firstly, if you already have a business plan, decide whether the plan is in shape to be presented to a potential funder, or whether you need to rework it.

The Purposes Of The Business Plan Are Various

The plan is a presentation of a company and its opportunities.

It can serve as the basis for strategic planning, and as a management and control tool.

It enables an investor or financier to evaluate a company, and assess the risks and prospects for return on investment.

It requires fact-finding, and forces the management to be realistic, and to put theories to the test. It should prove the management team's planning capabilities, and reduce the time required to study and negotiate financing.

A plan should be prefaced by a summary of the business opportunity, and the key aspects of the firm, including information on:

objectives;

desirability of products or services; or feasibility of the project (such as in the case of real estate development)

markets (if applicable);

management team;

financial projections;

amount and nature of funding required, and the estimated return this will produce.

The plan must include enough information to enable a lender, investor or financier to make a decision, but it must not be overloaded with superfluous or irrelevant detail.

The plan may be prepared by the entrepreneur, or the management team of the applicant company itself, or it may be prepared by an outside specialist. Sometimes, however, the applicants themselves have better and more knowledge of the project than they can impart to an outsider. Nonetheless, it is usually wise to have the plan evaluated by a knowledgeable outsider before presenting it to potential lenders, investors or funders.

The plan must demonstrate that the project is able to meet the funders criteria, in areas such as:

the management is qualified;

the description of the market and marketing methods is well established and realistic (if applicable)

the property has a sufficient valuation (if real estate)

the projected new funding will be adequate;

the product is competitive; or the project is profitable (for example, in the case of real estate development)

the production capacity will be adequate (if applicable);

the probability, if the plan is to be presented to an investor, of an attractive return on investment is high.

The applicant for the funding should have:

prepared a 3 to 5-year plan;

undertaken and documented a specific feasibility, and, if applicable, marketing study;

be prepared to make a personal financial commitment. (In all cases of pursuing substantial funding, the applicant will have costs and expenses involved with the application);

divided any large-scale plan into phases;

provided a list of users, suppliers, clients, etc. who are ready to act as references;

included both strengths and weaknesses of the business plan (this adds credibility, and underlines the practical knowledge of management)

In general, the plan must be adequate to the situation. Nevertheless, certain basic information is necessary in all cases. This includes the company's major objectives, opportunities and profit targets, any assumptions made, resulting forecasts, special risks, and also CVs of the management team.

Of course, there has to be some flexibility in the content of the plan. For example, a project based entirely on real estate development would not contain details relating to manufacturing, production and sale of a product, etc. On the other hand, a manufacturing project may well require real estate details, if there is, for example, factory real estate, which is part of the assets to be acquired, or to used as security.

Pay attention to the business plan, prepare it in a professional manner, and it will greatly ease the task of obtaining finance for your commercial, industrial, or any sort of project.

Business owners that "elected" to secure a Commercial Hard Money loan for their business are often surprise how quickly the time passes when they are expected to pay off that debt. There are of course only 2 real solutions to this. 1. Sell the property and pay off the loan or 2. Refinance the debt with another lender. The third option is to call your rich uncle and have him pay it off.

The game plan of course with most business owners is to give themselves some time to restructure their books, business, improve their credit score and essentially put themselves in a stronger position to get a conventional mortgage in a year or two. However, this may not be enough time or the problems were more difficult than expected. We see a lot of people that their primary issue is their personal credit score with the belief that they will increase it dramatically but at the end of the term there score has only moved up slightly. Regardless of the reason, the borrower may not be eligible for a typical conventional commercial mortgage.

One traditional option for business owners to get of the hard money loan is to go the SBA 7a loan route. This is because the 7a program allows credit scores as low as 520, loan to values as high as 90% on refinances and the borrower is allowed to use projections rather than just historical financials which may not show enough income to service the debt.

But this option has had several negatives that make it, almost as low of an option as the hard money loan to begin with. For example the rate normally floats over prime at around 1-2.75%, adjusting once per quarter - with no caps on the rate. In addition, the SBA normally requires a Guarantee Fee of 2.75% of 75% of the total loan amount. So in short, the benefit is that the borrower gets an option besides hard money and the rate is normally lower, depending on what Prime is than what they could get from another hard money lender.

However, not all SBA lenders are the same and it pays to be informed. For example there is a bank that offers the SBA 7a with a 5 year fixed rate at Prime + 1 and the bank absorbs the guarantee fee... As of this writing Prime is at 5.25% so most borrowers rate would be 6.25% fixed for 5 years and amortized over 25 years. This is one of the best commercial mortgages in the industry - regardless if the borrower is perfect or not.

So, if you're facing a ballooning hard money loan and you operate your business out of a building you own you may consider going the SBA 7a route. Regardless get out there and shop because there are more options out there than your local bank is aware of.

Gasoline prices set a record for the 16th consecutive day Wednesday. A gallon of gas cost an average of $3.62, according to AAA, and much more in some markets.

Interest rates constantly fluctuate, so when is the time right to refinance your home? One of the tools that can help you decide this is a mortgage calculator.

It shows you what your new payments will be, and whether the difference is worth the leap right now.

The most common reason to do a straight refinance is to take advantage of lower interest rates to lower the payment or reduce the term (the number of years to finish paying off the note.)

To work with a refinance mortgage calculator, you will need to know details about your current loan like the original loan amount, the original term (number of years to pay off), the number of months you have already paid, your interest rate, and, perhaps, the number of years until you intend to sell.

For the new loan, the mortgage calculator will want to know the loan points and interest rate on the new loan and approximate closing costs. Do not even try to figure it out on your own. Just look up several refinance mortgage calculators on the net and open them in separate windows or tabs in your browser. Start filling the figures into one after another, setting them to calculate as soon as they are loaded. Now, take a break, and relax. When you are ready, return to the computer for the news.

Have a look at the figures for monthly payment, term, and the breakeven date. See if the mortgage calculators come anywhere near agreeing. Like the scoring in the old Olympics, throw out the high and low numbers and average the rest to get an approximation on your savings.

What you are concerned with is the breakeven date. The breakeven date is determined by the mortgage calculator as the month in which the savings on the mortgage covers the cost of the refinance itself. If the breakeven date is five years down the road and you are selling in four, then it does not matter how good the interest rates are.

You will still lose money. On the other hand, if you are expecting to stick around more than five years, now is the time to go for it. You can redo the figures on the mortgage calculators with different interest rates and different terms (number of years to repay) to see where the breakeven point and the terms line up with what you can afford to give you the best deal.

But what if you have a different reason to refinance, say to "cash out" the equity of your home, for whatever reason. Emergencies happen, debt consolidation need to occur, and a good mortgage calculator can still help you figure out how to get your best deal.

When you feel like you know what you want, print out the best options, collect up your documents and head to the mortgage broker. One note: a refinance is a new note; you will be paying all appraisal fees, points and closing costs associated with a brand new note. The mortgage calculator does not take this into account. Proceed carefully and cautiously.

Oil prices up on word US ship fired on boats in Persian Gulf (AP)

AP - Oil prices rose sharply Friday on news that a ship under contract to the U.S. Defense Department fired warning shots at two boats in the Persian Gulf. Retail gas prices as expected rose further into record territory, nearing $3.60 a gallon.

Maria Wing is a lawyer in Philadelphia -- 28 years old, single and in debt. Until recently, single women like her were largely ignored by candidates and disengaged from the political process. But she and thousands of others could prove key in Tuesday's Democratic Pennsylvania primary and again in November.

Some thoughts on injuries in car accidents. Insurance companies try to sell the idea that if there is not a lot of damage to your car, you can't be seriously hurt. This has been disproved by numerous studies, but let me tell you about a demonstration that some attorneys have used at trial to demonstrate injury to the jury. A low speed car accident can push your body and brain back and forth, even without a lot of property damage.

A good lawyer trick: A trial attorney may hold up and drop a carton of eggs to the ground. The eggs break, yet the carton remains visibly undamaged. Like the eggs, the human body can be hurt, yet a car, like the egg carton, can show very little outside damage.

Insurance companies seem to have the attitude that everyone exaggerates or fakes pain. In thousands of negotiations with insurance companies, I've heard them "poo-poo" clients' complaints of pain. Pain alone won't carry the day, either for settlement, or in court.

What do we mean by "No-Fault"?

Put simply, No-Fault refers to having your accident-related medical bills paid, up to $50,000, regardless of whose fault the accident is.

Two different things happen after a car accident. First: No-Fault insurance pays your medical bills and lost wages, except in certain instances involving buses, motorcycles and heavy trucks. No-Fault also protects pedestrians and bicycle riders. Second: This should not be confused with issues of liability in an accident, which are very much about who is at fault, and the focus of the second thing that may happen: a lawsuit. Let's learn about No-Fault insurance and what it means for your he satisfies the requirements of the No-Fault law. The No-Fault law precludes recovery for pain and suffering, between "covered persons," unless the accident victim proves a "serious injury." This is one of the most litigated sections of New York law, with many, many reported case decisions. And at this point, we are not even talking about liability (fault for the accident), which is a completely separate issue. We are only talking about the degree of injury.

The nine No-Fault serious injuries in New York State's Insurance Law are:

1. Death (brought about by the accident);

2. Dismemberment - mangling, mutilation or dismemberment (loss of) a body part;

3. Significant disfigurement (a scar; there's no hard and fast formula for scar size - depends on the visibility of the scar; usually scars above scalp line don't clear the threshold);

4. A fracture (broken bone);

5. Loss of a fetus (traumatic abortion);

6. Permanent loss of use of a body organ, member, function or system (the first of the "tricky" categories);

7. Permanent consequential limitation of use of a body organ or member (pain alone won't do; headaches alone won't do; a herniated/bulging disc alone won't do; sprains/strains won't do);

8. Significant limitation of use of a body function or system; or,

9. A medically determined injury or impairment of a non-permanent nature which prevents the injured person from performing substantially all of the material acts which constitute such person's usual and customary daily activities for not less than ninety days during the one hundred eighty days immediately following the occurrence of the injury or impairment (known as the 90 out of 180 days rule).

The first five are the easy categories, they are fairly straightforward.

The two less tricky categories:

Number "6": If you can no longer use a part of your body, you can qualify.

Number "9": Usual and customary daily activities generally means that you miss three months of work in the first six months after the accident, but there are two wrinkles. First: Your failure to work has to be medically determined. In other words, your doctor must say that you can't work. Second: You need to show that you couldn't do any of your other customary daily activities. This may be housework, driving the children to school, or other things.

The two trickier categories:

Numbers "7" and "8" have no fixed definition or explanation. Some cases make it; some don't. Your lawyer needs a thorough understanding of the current case law to know how the courts are applying these two threshold categories. Frequently, it comes down to documenting a reduced range of motion in the injured part of your body - for example the doctor determines that you can't fully bend or twist or turn your back or neck.

AP - Defense Secretary Robert Gates said Monday the Air Force is not doing enough to help in the Iraq and Afghanistan war effort, complaining that some military leaders are "stuck in old ways of doing business."

Many parent with teenagers are pretty responsible drivers, and so they enjoy some of the best insurance rates. However they are shocked when they see the premiums for the young drivers in their household. Many teenage car insurance rates, especially for boys, can triple their parent's car insurance bill! However, car insurance companies also realize that some young drivers are better than others. Many car insurance companies will offer young driver discounts for a couple of actions they can take. Car insurance companies like good grades, and so a B average or better will earn a discount with many top companies. Also, taking the time to take an accredited driver safety class has been proven to reduce accidents, and they also usually come with a decent discount. Check with your insurance company, or a few insurance companies, until you find out where you can take a class that will shave a few percent off of that premium!

Of course, many insurance companies will also offer a multi-policy discount. So if the same company handles the same family's home insurance, other car insurance, plus the student driver, you may enjoy the best rates out there.

However, I do have one more tip if none of this works. If the family car is fairly new, consider the purchase of an older car for the student driver. Only put liability insurance on that car. Even the used car payments, and the liability insurance premiums, are likely to be less than the newer car's full insurance protection. Besides, your family will get an extra car too. Just do not let the student driver use the newer car.

Let's take a very broad look together.

There are three main pieces to an ecommerce site: the website and shopping cart, a payment gateway, and a merchant account. The website and shopping cart allows people to shop and place things in their virtual cart. It gives them the information they need to make a purchase. That's the easy part to understand. The hard part comes when we start thinking about the things we don't see. This is especially true when it comes to the payment gateway and merchant account.

The payment gateway can be thought of as a broker and a bouncer. They broker the deal between the customer, who is purchasing on your web site, and the merchant account. The payment gateway makes sure the transaction goes as planned. It makes sure all the necessary information is being obtained. If it isn't, then the payment gateway puts its bouncer clothes on and sends you packing. The payment gateway handles the transaction.

The merchant account can be thought of as the banker. They are the one who interfaces with the credit card being presented and the billing that needs to happen. They make sure that the buy gets billed and you get paid. I like the banker. Now, because the merchant account makes this transaction happen, they will want to be compensated for their service. The payment gateway is no different.

This is where the waters start to muddy even more. The fees that these services charge can be different from place to place. This can make comparison shopping very difficult. The various fees include: installation fees, discount rates, fixed transaction fees, miscellaneous fees, etc. It's enough to make your head spin. And getting all the pieces to work together can be a real pain. Sometimes getting an all-in-one service is the best way to go. But that all depends on what your requirement are. Now that you know the big picture, I think the pieces will be easier to understand.

Reuters - A 5.2 magnitude earthquake centered in southeast Illinois that was the strongest in the Midwest in 40 years startled residents before dawn on Friday, but officials reported no injuries and only minor damage.

Most people make purchases through their cards. It is so convenient to use. You don't have to bring bulk of cash in order to make huge acquisitions. But we have to keep in mind that our credit cards contain valuable personal information which can be stolen and cause our nightmare.

Thieves can use the information stolen in two ways. They can open a new credit card and register it under your name, giving you the burden of paying for it while they do the shopping. Another is stealing your card and for them to use it as their own, unless you report it immediately, the thief will enjoy using it.

There are signs that a card is not legitimate. Because of this, personnel or sales clerks processing the payment should watch out for signs of fraudulent card payments. A card may be bad if the person using it cannot show any other identification. A thief may not have any other identification similar to the information appearing on the credit card. Another signal is that the fraudster will not usually sign the charge slip because there is usually a specimen signature of the real owner on the back side of the card. Different signature means he is not the real owner of the card.

Fortunately, there are ways on how to protect your credit cards. One is to always keep your cards close. Don't leave it unattended in a public place. In the workplace for example, you may not know it but an identity thief may be in the next workstation. Don't leave it in your vehicle either. Because thieves will surely find ways to get hold of it.

Always protect your Personal Identification Number or PIN and security code. Don't write this information down because the hardcopies of identification can be misplaced and may land on a culprit's hands. Secure it when you're traveling as well.

Once you made a purchase, check the card immediately when returned to you. Make sure that it is your card. You should also check the device use in accessing your card because it can be a skimming device. Credit card skimming is also becoming a worldwide problem as a method of getting hold of your personal information. The best way to avoid this is to use your card at reputable stores duly operating with full licenses and business permits.

In case a credit card is missing despite diligent efforts to find it, immediately report it. Stolen or lost cards should be blocked to prevent the thief from using it. Reporting of such cards is easier when you have a list of your card and their identification numbers filed in a secure place. Remember to list down the contact phone number or hotline of your card company too.

It is also very helpful for you to check the billing statement regularly. You will easily identify unauthorized purchases this way. If you are able to find any, report them to the card company right away. And be careful to whom you give your card number especially when on the phone. Give information only to reputable organizations. It is important that you have the right information of the person on the other line since it's your account that is at stake. One mistake and it may cause you a fortune.

Rent a movie? Almost anywhere you rent anything from now requires a credit card for the business owners security. Do you want to make purchases online? Although there are other options for payment online, credit cards are still the most widely accepted form of currency by far.

Originally Prepaid credit cards were designed for adults who could not obtain a traditional credit card due to having either no or poor credit history. Some of the cards actually have credit rebuilding features that report to the credit bureaus regularly. These same cards can be a valuable asset to our youth. Chances are our children will never use a checkbook so why not teach them how to use and manage a credit card from the beginning.
